“Change” for Obama: gut the 1st Amendment
Gateway Pundit and Instapundit both have descriptions of Obama and Obamabots that are combing the airways and published media to find anything that might put Obama in a poor light. When they find it, they are apparently threatening court cases, license revocations … whatever it takes to have arguments against Obama and his policies silenced.
KMOV aired a story last night, that stated that St. Louis County Circuit Attorney Bob McCulloch and St. Louis City Circuit Attorney Jennifer Joyce, both Obama supporters, are threatening to bring criminal libel charges against anyone who levels what turns out to be false criticisms of their chosen candidate for President.
Another part of the KMOV website described the issue,
The Barack Obama campaign is asking Missouri law enforcement to target anyone who lies or runs a misleading TV ad during the presidential campaign.
I watched the Presidential debate on Friday. I saw and heard Obama swear up and down that Kissinger supported his plan to hold presidential level meetings with Ahmadinejad without pre-conditions; CBCs Katie Couric did the same thing. It wasn’t until McCain clarified that Kissinger was referring to secretary or lower level meetings with the Iranians that Obama started to backtrack and claim that “no one was talking about” Presidential meetings. What Obama did in this case was clearly “misleading” and under the threats being leveled by his supporters in MO, an Obama opponent who did this sort of thing could potentially be up on criminal charges.
To clarify, I have already stated on this blog that false ads should be exposed as false. However, this move by McCulloch and Joyce and other Obama supporters is not meant to clear the record. If they were interested in doing that, they would be writing letters to the editor and publishing corrections in whatever media outlet they could access. Their threats of criminal prosecution will have a the effect of censoring campaign-related speech, primarily because of the “misleading” aspect of their threats. How many people have the time or money to fight a prolonged court case against a group of stridently left-wing LEOs who are threatening criminal actions against anyone who they claim was “misleading” in an ad.
Whether they intend it or not, McCollugh’s and Joyce’s actions are an attack on our free speech rights and this is precisely the sort of abuse of power that Obama should be standing firmly against. He claims he is for change, but he is (and his supporters are) sticking to the politics as usual theme of abusing power to silence dissent.
The Instapundit has an even larger list of First Amendment abusers in this post.
This is classic Obama – to one radio station, stop running NRA ads or we’ll have your broadcast license revoked. More of the same explained here. Volokh looks into the issue as well and some the comments on that post are equally insightful.
Interesting thing about Obama trying to get the NRA ads silenced – he’s trying to take out the first two Constitutional Amendments in one blow.
This Pajamas Media article, describing how Obama-supporting, Dept. of Justice lawyers are gearing up for the election will give pause to anyone who still remembers that there is a Constitution out there.
